I recently saw a drive through daiquiri bar in Texas and I was curious how it would be legal, and if it is only legal in certain counties.

From what I've been told, the drive-thru daiquiri bars are legal (in some places) and they manage to get around the 'open container' thing because they won't put the straw in the cup for you.

Seems a little sketchy to me though....

Yes I would think so / so long as the driver is not intoxicated ?

I am not sure if this varies / state by state / county by county ?

There is something about "open liqour" in some places.

In the Grand Cayman Islands, if you do not finish a drink at a bar, you have an option to have a T-GO / Plastic cup.

Lots of states allow drive-through liquor stores to exist. However, that does not mean the driver can legally start drinking in the car. Most states require that the alcohol is consumed outside of a vehicle (with the possible exception for chauffered vehicles).

There was a place in Atlanta I used ti go to called Taco Cabana that sold margaritas through the drive-thru! I dont know if it was legal though.
