I tired to pay at a restuarant with a $100 bill that was rejected. I had no idea that the bill was fake and the cashier says that he had a right to take it from me. I told him that I wanted to take it to my bank to confirm and so he just gives it back. Ok, who is in the right here?

the restaurant said that they put it in a machine which i know they have, but do not even trust those. i have no intention of using it again; thanks for those who advised me to go to the bank. the pen said it was fine. i have nothing to hide, there were cops dining right next to us!!

Counterfeit pens are not, by ANY means 100% accurate. You are right in wanting to take it to your bank for verification.

If the bill is a counterfeit...it is nothing more than a piece of paper to the waiter and he has no right to take it. It is the same principle if your credit card is declined... The business does have the right to call the police (doubt they ever would) and they can take it and start an investigation. I would go back to where you got the bill from.

i do wonder about the teaching that leads people into denying who they really are, putting up a very exergarated front and then going back behind closed doors and committing the most heinous act that normal people wouldn't dream of. That is the problem with religion and the religious. The problem being, you guys take refuge in denying who you are, putting up a perfection front and then just going overboard. Ridiculous! At what point do you stop and figure, THERE'S NOTHING WRONG WITH MY REAL SELF! I am not a wretch, i don't need to be washed because i am not dirty, i am just me. Few words but still elusive to the religious. And what's the alternative, from small acts of guilty masturbation (nothing wrong with it of course except for the guilty part) to pedophilia as in the catholic church. Add ted haggard and the rest to it and you have the complete picture

How did he know it was fake.??? You should take it to the bank, (like you told him), and if it is fake, the bank will keep it.
Do not try to spend it again, without finding out for sure, because you can get in trouble. I'm surprised that the cashier didn't call the police.

There are ways to tell, from special pens that mark in different colors depending on the type of paper (one color if US currency paper, another if not), to the many built-in counterfeit-thwarting features on the bill itself.

A business does not have to take money that is not US currency as payment for a debt, if they use one of those features to determine that it is not; but it seems odd that they'd just give it back without any attempt to notify authorities. They couldn't just keep it either, though, in case you are indeed a victim also -- and in case it was legitimate and the cashier was just trying to scam you! Protection both ways.

the cashier had no right to take your money like that. if it turned out to be real there is really no way to track who has it. there is no way to know if they didn't switch it to a fake one of their own and blame it on you. you should always have that bill on sight at all time. even if that means staying there with the cashier until the right authority arrives to check out the bill. but the bill is out of your hands and only time will tell what happens

the restaurant CANNOT take the bill from you, BUT, they can use reasonable means to detain you while the police are called. The Secret Service, a unit of the Treasury Department, gets involved with all counterfeit bills, so if you have any idea where you got the bill, assist them as best you can.

He is in the right to keep it. But the police should have been called right away..... You said the pen showed you it was ok???? I think the clerk was a little quick on the draw dont you...

He doesn't have the right to keep it. Get it back and as the previous guy said, try using it somewhere else. If it is fake, tell the person you were unaware and that you are going to take it back to the place that issued it to you in the first place.

you can go into just about any place that handles money and ask
to borrow their counterfit pen. draw a small line on the bill and if it turns brown it's ok. dont let anyone take it from you without proof.

The mgmt of the place could have just called the cops to see what they thought about it.
So have you been able to spend it, or no?
