Depends on your state law.... Here in New York, you can if your taping from your own property or in a public place. Such as a ball game, motorcycle rally, historical reenactment, etc. However you may run into problems if you wish to use said tape for profit or commercial reasons.

If your setting your camera to invade a persons privacy, such as "up skirt" or cleavage shots. You may be in violation of the law.

Of course it is illegal. Every time there is a Houston Astros baseball game the people in the stands are taped. Some little guy runs around and gets every one of the 38,000 people attending it to sign permission.
Or when the Boston Marathon is run, all 200,000 people watching it have given permission.
Unless of course you are trying to hide something you are up to. Is that what you meant?
My best answer is this: How the heck would anyone on here know the answer to that for every state?

it's not illegal

It's constitutionally protected right under the First Amendment to photograph and video in a public place. These rights are rooted in the First Amendment's strong protection of speech within "public forums." A "public forum" refers to a public place historically associated with free expression. The most commonly recognized examples include streets, sidewalks and parks. Within these areas, the government's ability to limit the public's speech is extremely limited.

I think it depends on where the people are and what you end up doing with the videotape.

Yes it is against the law to video tape a person without DISCLOSURE. That is why when you drive into the parking lot of your favorite store, you see a sign up saying that security cameras are in use. This puts you on notice that you are being taped.

Keep that in mind when your kid needs a spanking, wait till you get home or it will be on the national news.

No that is an invasion of privacy.

It can be done if you are trying to record illegal activity, but without a warrant that tape is not admissible in a court of law.

You could post a sign saying, "Warning Video Cameras are in use on this Property" that would be a valid warning if the sign is clearly posted and then you can use the film to support a legal case. It will still be hard to get it admitted as evidence in a court though.

It depends on the circumstances, and where you live. It's illegal to record their voices, but it's okay to just picture them walking along a street or something. If they're doing anything specific, or either you or they are on private property, you'll have to blank out their faces, and any car license plates, patterns on their shirts, etc.

No, it's not illegal to video tape people in PUBLIC places.
Even if they ask you to stop filming them, you don't have to.
How do you think the Paparazzi make such a good living?
But, it would be better & safer for yourself to get a signed consent form, just to cover your own bases.

I believe so, as long as you are in public anyway. How else can you explain those paparazzi? Photos, videos it's all the same. I look at it this way, if it is something I don't want other to see, I don't do it in public.
