I'm wondering if I should wait until the matter is resolved with the Labor Board and the check for my hours owed is given to me, or whether it's okay to cash it now.

In addition to indicating on the check that it is only a partial payment, take a photocopy of the front and back of the check and stub. This is your proof of the amount of the check.

It should not affect your wage claim to deposit your "partial" check.

If the organization has paid you what was owed you can cash it. Then contact DOL and advise them you have been paid. They will decide if whether to continue an investigation or close the case.

Copy the check and cash it, so long as it doesn't have any endorsement on it such as "in settlement of all claims." Besides, you generally cannot waive your right to collect your wages.

When you endorse it to cash it, mark it as "accepted as partial payment".
