I'm thinking this would be an awesome ADA lawsuit...

She probably couldn't do the essential functions of the job, so probably not. ADA protects the disabled from discrimination and provides access, it doesn't mean that they get to sue whoever they want.

The question would be if she is capable of reaching the customers and delivering the product to the high tables. I do not think you could compel Hooters to make changes to the way locations are organized for one employee, and such cumpulsions would be unreasonable.

A handicap person could work as a door greeter, or a backroom cook, or as someone in logistics though.

Waitressing is a physically demanding position, and someone in a wheelchair would be unlikely to handle the constant movement and rush of waiting tables. There would be no way she could manuever in the kitchen or through crowded restaurants with a wheelchair.

Ever try to maneuver a chair in a restaurant? Now try it with a full tray of dinners.

No ADA here. No reasonable accommodation could be made.

I think you're right. I think about stuff like that a lot. Don't know why. Doesn't effect me, just interesting to think about. Or what about white people suing all black or other minority fraternities for not letting them in? Minorities could sue a fraternity for not letting them in if there weren't any people of their race in the frat/sorority. They'd probably win, too. Just like that one sorority that got in trouble for not letting chunky or minority girls in (don't remember where it was, but it was recent). I think people in the majority could start suing for reverse discrimination in some cases, but that's me on a tangent.

YES!!!! That would be discriminating and Hooters has gone through plenty lawsuits because of discriminating against small chested woman.

That's a great idea actually. She'd probably make killer tips and put the location in the national news!

if she could, she'd have amazing upper-arm strength from holding a tray in one hand and maneuvering her wheelchair with the other.

I don't think it would work too well if she tried moving her wheelchair with the tray in her lap.

Why fan the flames? You'll only get smoke in your eyes.
