It depends on the state. Most of them allow you to use deadly force, but only if the intruder threatens you with force first. I don't think this is much of an issue, as it would be a simple matter to grab a kitchen knife and put it in his hand after he is dead.

DO IT! If it were up to me I'd have a firing squad all along the border to shoot people for just thinking about coming here illegally! Maybe if you shoot him he'll tell his friends, and if you do it right, he can't tell anyone!
