Anybody can sue anybody for any stupid reason they want. But the likelihood that someone would win such a case is almost zero - it would probably get thrown out of court. They would likely be doing it on their own too, as no attorney would take it. The only time a case anything like this has a chance is if you have a married couple, one has an affair and the non-cheating spouse sues the cheating spouse's lover for "alienation of affection". But that's not worth doing unless the lover has lots of assets to go after.

Only if the ex can prove (in a court of law to people who have seen and heard every sob story imaginable) their damage keeps that person from making a living and it's not something that could have been avoided. Almost impossible to do unless you're talking about physical battery and being locked in a closet against will or something.

You can be sued for "intentional infliction of emotional distress," but the elements are difficult to meet. Courts tend to look askance at these claims.

There must be an intentional or reckless act, extreme and outrageous conduct, causation, and the plaintiff must actually suffer severe emotional distress.

Before any relationship, I make my to-be-lover sign a wavier stating that their heart may be used as my personal piñata, that I am not liable for any potential heart or emotional damage. As all would attest to, any pain incurred was worth the pleasure received. :p

I'm sure there are some ambulance chasing attorneys who would try. In our ever-litigious society, we seem to sue for everything these days. It's almost taken the place of regular communication.

I would think in order for the suit to be successful, there would have to be a proven track record of mental duress. If they sought counseling for it or medication for it, and there are witnesses, it would be possible.

A lot of merit-less suits get filed too, just in the hopes of a payoff to make them go away. Kind of like legal extortion. That's why you see people who claim they are innocent pay off their supposed victims (like Michael Jackson did in those child molestation cases).

This is a sue-crazy society. People have sued over much less, I wouldn't be surprised.

YOu can be sued pretty much by anyone for anything; without a lot of doctor's documentation, not much chance of winning.

I don't think you can. Can you just imagine how overloaded the courts would be? Who hasn't been mistreated by some douche bag at some point in their life.

This is America. Anything can happen if you have the right judge and a good lawyer.

I wouldnt sue, but good luck if thats what you decide to do.
