The space rented out is in a commercial area. The tenant is a close friend of my brother. She will not give me a copy of her lease contract. I have informed her verbally before she occupied the space that i am part owner and the lease contract should be signed by me and my brother. She went ahead and occupied the space without my knowledgeand said that she has a contract with my brother. I don't know how to go about this legally.

looks like if your brother will not cooperate on this then you will have to get a lawyer involved, you have a legal right to half the rent, and half say in who rents the space

if this is going to be an on going problem best bet maybe is to force the sell of the place and divide the monies equally

You need legal advice; talk to an attorney. You may well have to sue your brother to get your due.

Your verbal notice to the tenant is meaningless. You should have had an attorney serve notice on her and your brother that there were other interests in the property. She can claim to be an innocent third party so there's probably little that you can do about her.

Your brother has a duty of accountability to you. Being that it is family it is a sticky situation. You may want to seek the advice of an attorney.

have your attorney contact your brother to resolve this issue.second set up a accounting system or inform your brother its time to dissolve this partnership.
