We had 4 sons and divorced in 1983. I recieved one check from him and after that I never recieved any more. He claims he finally got all the back support paid off. I was on food stamps and aid for depencent children for afew years then they went to live with him and then a couple of years later returned to me. So I don't know if the state got it and took it to pay for what I was getting from them or if they were suppose to give me part of it or what but I never recieved any of it from them. I lived in the state of Tennessee so where would I be able to find out about if I am owed any of it from the state? He lived and still lives in the state of Alabama.

if you were collecting welfare and/or food stamps, then the money he paid for support went directly to the state to refund them of the money. call your child support service center and ask for a payment history. i got mine in 3 business days. also ask for a pay out history so you can see where the money was sent.

You need to call the county office to find out. They have a child support service. They can certainly tell you the answer you need.

If at one point the children lived with him, he did not need to pay you child support. That is the way the system works.

I feel for you because I did not get child support at all. They now have rules that will let you reclaim any child support you did not receive. Go consult Legal Aid for help if you cannot afford it. He sure messed you up.
My ex even spent time in jail and still would not pay. He just disappeared and it is too late to get the back child support. I don't even want it know, because my children are grown but I sure needed it when they were young. If it had not been for my mother, I would have been homeless.

First of all your children were living with you after being divorce for about twenty years and he claims he paid back child support paid off. you were on aid from the state. food stamps and aid for dependent children. all you got was one check from him and never received anything else if you have a case number you can see if it was paid off. check with the child support unit. If you are entitled to the back pay he owes you. even though these kids are not with you are entitled to back child support.


This information should be in the child support unit.

The aid you received was paid from his payment to the state. If a parent can not pay child support, the state will give you aid, but if that parent can pay, and its turned over to the state, his money is used to pay the state back. If they did own you any money, don't count on getting it back.

You can sue his estate for the back money. If you did not remarry you are entitled to collect on his social security at what age I am not certain. I know if you where still married you would be able to get survivor benefits at 60, but since you are divorced I am not certain. You can go on the social security web site and get some of the answers, but the others ones you should call the office and get that information.

You have it pegged. In many states . Any support that a person pays, first goes to the state to repay them for actually supporting the family. The assumption is that if he were there he would be doing it. Since he is not They did. You would be
entitled to receive no monies from them.

all the money he paid reimbursed the state for the food stamps and aid you received. If you provided his name to the assistance office they automatically receive the payments that are suppose to go to you, the money you recieved is pretty much like if he was paying you. he pays them, they pay you.

I would say that the state took the payments in order to pay for what you had gotten for the children. However if he claims to have paid it all you need to do is to ask him for proof of payment, receipts, bank statements etc.

I'm also in the same situation i receive the government assistance and the child support that my ex pays it goes directly to the government , but when you stop receiving that money the child support payment will than come to you .
I'm in Canada but i think it's the same in US.

Yeah I would definately check with the states attorneys office and see if they have any records of him paying anything . If not then you can proove and you could get a copy of it from the state attorneys office . the burden of proof is on him . although I dont know why it matters now .
