They were allowed to keep their points because they helped in the investigation on McLaren and this is the deal they made with FIA before the council took place. The whole shebang is actually bad for the sport but once you get it started it's very hard to set a limit as to how much to penalise them unless you kick them out completely and then the consequences would be catastrophic and everybody would laugh at the FIA and F1. Don't get me wrong, I think they benefited from the info but not to a large extent.
Again, to answer your question, I think money talks and it's just the size of the team and the sponsorship and money it brings into F1 that the FIA cannot afford to lose.

The whole case is totally outrageous and suspect the architects were Ferrari and maybe Alonso both jealous of the outstanding performance this season of the Mclaren cars and our new super star Lewis.Ron Dennis would not cheat at snap let alone in a sport he is and has been devoted to for many years.But their is an option and that is to start a new F1 league and to hell with the likes of the exsisting body.The fine and the loss of the Constructers points go beyond beleif.As dedicated supporters of this great sport we can make a reversal of the descision given by these crazy buffoons.

its an absolute outrage they didn't use any of the info on their cars and it sure isn't the drivers fault so they shouldn't be penalised Ferrari have been caught cheating in the past and dint receive such a severe punishment i feel very sorry for Mclaren i think the fine and point loss is way over the top!!
Just goes to show that fia really stands for Farrari International Assistance!!

This question is mostly answered by Mclaren fans.I understand that they are just showing their opinions on their favourite team. But they have got to realise Mcalren actually held those documents for some time.(Quite a lot of documents,780 pages!) They may have not used them on the car itself,but the fact is they stole them,and that's that.The verdict is decided,the fine is given and the whole controversy is over.
Let's just enjoy these last 4 races okay! :)

FIA has clarified on this issue.
"Due to the exceptional circumstances in which the FIA gave the team's drivers an immunity in return for providing evidence, there is no penalty in regard to drivers' points."
This should make it clear, FIA didnot penalize the drivers as they had promised.

its a fix, set up, bribe. whatever u wanna call it. Ferrari aint going to win races so they fixed Mclaren.
looking at it from another angle, who is to say that if the guy still had a Ferrari email he could use, that he wasnt spying on mclaren for Ferrari & passing on information back to them.
