Hi, I have a friend the USCIS alleged to have committed fraud in getting her greencard 5 years ago. She was under derivative from her US citizen mom.

The rule said, while the application is pending, she is to remain unmarried. She did. She only filed for marriage license when her boyfriend was ready for marriage, 2 months after her green card was approved.

Incidentally, she has 2 children while her application was pending but never legally married.

While staying in Indonesia, her ID card and family card were erroneously printed as married. She has obtained the record from the civil office in Indonesia stating that she has never been married.

Indonesia does not recognize common law marriage, nor California where she has been residing.

On the Notice to Appear for removal proceeding, it says that the allegation was that she claimed she was single, when in fact she was married. Does USCIS has legal grounds for the allegation? She is distressed.

Of course they do. There are conflicting records. There are some that indicate that she was married. She needs to gather all records she can and attend the hearing. Hiring a lawyer that is versed in immigration law would also be a good idea.

People can and do lie or misrepresent their status when attempting to get a visa for America. When circumstances change, they backtrack and try to make papers match the current needs.

Not saying that is your case, but lord knows we have a lot of that going on. Sounds like your friend has been here awhile. Why didn't she become a citizen? Wouldn't have this problem then would she??

They have rules to follow and if she lied, she is in deep dodo!
You will have to wait for their decision to decide what next step if any to take!
