I found out he was using me to get into the U.S and when confronted he vanished. At first he told me that he will never divorce me ever! That he can marry up to 4 times in his country, so this will not effect him at all. I haven't heard from him in 7 months and now, how do I get a divorce from him here in the states? I don't know where he is or no phone number, no address nothing! No way to contact him to get the divorce and have very little income. What do I do? Please help me! He never stepped foot on this soil. We only lived together "married" for 2 weeks in his country. Yes foolish thing to do, but I did believe in him at the time. I was going through some emotional times and tragic events and he took advantage of that. Once my mind became clear and I saw him for what he was... it was to late. Now, in his country he can say that he doesnt want me for his wife anymore and we are divorced. He did say that to me. But, now how do I take care of the rest here in the states?

California is the state and I already notified immigration. stopped the petition. Nothing was filed in the courts. Just through trying to get the visa. so now what do I do?

This is not so difficult. Here are a few things to consider. Do you have a copy of the marriage certificate? Do you have contacts in the country that he comes from that could find out information about your marital status? If he is going to divorce you in his homeland by "declaration" than go ahead and let him declare his divorce. Just make sure you can get a legal certificate that recognizes that he is no longer your husband. He will not be able to enter this country if he has married more than one woman. The american embasy will require him to file divorce papers on his previous marriage before they will recognize the new wife.
The other way to handle this involves the laws of whatever state you live in. For example, in Florida as long as you have been living in the state for six months they will accept jurisdiction in the matter. Every state has a statue on recognizing jurisdiction. Consult a lawyer about this problem. It is not an insurmountable problem. After jurisdiction is established then you will have to get your husband served so that he has notice that you are proceeding against him. There are ways to serve a person through a process called substitute service. It involves amoung other things service through publications in the area that you reasonably think he lives, or last lived. Again, consult an attorney and he or she can help you.

You don't say waht state you live in. Some states have forms that you can file without the services of an attorney.
You would send him the divorce paperwork at his last known address whether in this country or in a different country. When he doesn't show up to contest the divorce it will probably be granted to you on your ground as a no contest divorce.
You might go to legal aid for advice.

You can file for divorce on grounds of abandonment. You can contact an attorney for this or go through the attorney general's office. If the court is not able to find him after a specific amount of time, they will give the divorce.

1. Notify immigration services about that then can make sure he will not set foot in this country and also find him.
2. File for anulment of the marriage because he married you under falce pretence.
3. If he is still in his country and trying to get paperwork to come to the US, notify the State Department so they wont let him.
That should make him hurt.

I agree with Dimitar A. You need to file a report, so that if he wants to get into the states again, he will be denied or even arrested for fraud. I'm sorry you had to go through with this, but at least it's only been 2 weeks, and the marriage will be annulled. He gives us a bad name. I also came to the States to be married to my husband. Everyone, from his friends and family, to even his neighbours, warned him about something like your case, that I'm going to dump him after I got my green card. But unlike your ex, I really love my husband and looking forward to our old age together.

First of all, you may not even be legally married in the U.S.
Second of all, you don't need a divorce, you need a disillusion. (Disillusions are used to say the marriage doesn't exist when the other person can't be found.)

if you never signed any papers in the U.S. than he cannot do anything, unless you go to immigration with him. i would not worry about it unless you want to get married in his country again. if you are still worried contact your local immigration office or a lawyer that specializes in immigration.
bottom line you are not considered married here.

First got to the INS ! The Immergration authorities should be allerted. They can give you good advice. You can also go to www.ice.gov U.S. Immirgration Customs Enforcement
