I take intermitten FLMA leave for migrane headaches. My boss has been docking my monthly attendance bonus for the past 2 years. I also get comments about my attendance issues. They constantly say things like the next supervisor job is coming open and you should take care of your attendance issues. Is this right the way that they treat me and or legal? Also I was told people have no excuse to miss work FMLA or not they should be at work everyday.

FMLA does cover migranes it is considered a condition that requires ongoing medical treatment. Please be serious about your answers and have a grasp on what you are talking about.

I just checked the department of labor website:
The FMLA requires that employees be restored to the same or an equivalent position. If an employee was eligible for a bonus before taking FMLA leave, the employee would be eligible for the bonus upon returning to work. The FMLA leave may not be counted against the employee. For example, if an employer offers a perfect attendance bonus, and the employee has not missed any time prior to taking FMLA leave, the employee would still be eligible for the bonus upon returning from FMLA leave.
