Hate crime charges are applied in cases where race is the basis of the criminal act. It is not applied to cases where the victim was chosen for other reasons even if racial slurs were used during the commission of the crime.

For example: A Caucasian holds up liquor store run by a person from the Middle East and uses a derogatory term while telling the clerk to empty the register. This is not a hate crime. The target was chosen because of the money in the store, not the race of the individual.

In this case, there is evidence that the victim had a relationship with one of the persons involved in her detention and abuse. If something went sour with the relationship, she may have been targeted as revenge for whatever went wrong, not because of her race. As in the above case, her race appears to be incidental to her abduction and torture, not the primary reason.

You may also note that the report indicated that the Federal and State prosecutors have not chosen to file hate crime charges AT THIS TIME. The charges of kidnapping and assault are enough to hold the accused while an investigation takes place. The investigation may reveal that this was a race-based crime. At that point, the prosecutors then have the right to add additional charges.

Because the prosecutor said that they will serve more time in jail when they get convicted of alot of separate crimes instead of one hate crime. Like attempted murder, torture, rape etc...
