My husband works at a company called Smurfit-Stone. GP is buying them out but GP only bought the company and not the employees. So at the end of the month all employees will be terminated and they had to reapply for their jobs. If the old employees are not hired back do they have to offer a severance package or anything? He has worked there 8 years and never had any trouble. Don't know what can be done if they don't rehire him?!?! Thanks in advance for any help. And we are located in Alabama if state law makes any difference. Thanks!

It is possible they are developing a severance package.
The only thing they are required to do is offer COBRA rights, and offer you the contributions you made to the 401 plan, and the vested contributions they have made.
Any employee not rehired would be able to apply for unemployment, as they would be unemployed through no fault of their own.
It's only thee 12th, they should provide this info by the end of the month.
