A natural mother used to have to adopt her own child, but happily they put a stop to that. You don't really have any rights over an 18 year old so you've nothing to loose. He can use the same surname as you and your ex husband if he wants to without getting adopted. Just use it.

Your son is an adult now as he is over 18. Your parental rights are done as far as any of that is concerned. I think that he can legally change his last name to your ex-husbands but that still has to go in front of a judge for that to happen. Have your ex go to court with him so that the judge knows that he is okay with the change. I don't know that he can be legally adopted because of his age now. The only special circumstances that would change this would be if your son was disabled.

Your son is 18, you don't have parental rights. He is an adult and can do as he pleases. Your ex would have to adopt him, and you really don't have a say in it because he is of age. You can adopt at any age, but it is unusual.

I dont think its up to you now, as hard as this may be for you, but he is an adult now at 18 and can make his own choices. I dont really understand why you would need to adopt him as you state he is your natural son? If your ex is a decent enough guy to want to do this and their feelings are mutual - let it happen.

You can get adopted at any age. Your his mother you don't need to adopt your own kid. Your parental rights are running out as he is 18 and he can do as he wants.

Your son is an adult now. Your ex can adopt him if he wants to, but it doesn't mean much, it's mainly symbolic. I suppose it would affect his ability to inherit your ex's estate if he dies without a will. I don't see how it would affect your legal position, you would still be his mother wouldn't you? Since he's an adult, I don't think you have many "rights" anyway.

Why does he want to change his name - that of his father?
I don't agree that any male person should change his surname!
It is his heritage. He should be proud of the name no matter what the circumstances.
My bet is he will regret it in later years. He may be 'legally' an adult at 18 - but he is, in fact, still just a big kid.

I have a sister who is 32 and is being adopted by the couple who raised her. Well it will mean that he is legally his father.
