In the Border Patrol Academy we used the term "illegal" colloquially, but in all official correspondence, we used more exact terms such as EWI, Overstay, OTM, Smugglers, Out-of-status, Coyotes, False Doc cases, or the particular code section they violated was used. Not all illegals are criminals, and those who have committed what is technically a crime, are not all prosecutable. All persons who come here are deemed to be immigrants unless they can prove otherwise. Many are here because they are merely dependents of citizens or legal immigrants, who couldn't get immigrant visas. Overstaying a tourist visa is not a criminal offense, but half of all illegals are "overstays." A minor brought here by his parents has committed no crime. The statute of limitations on most crimes is six years, and EWI is a misdemeanor punishable by a $250 fine that we never bother with, since it takes over a year to even get it through court. The relative of a citizen who has been here over ten years, is usually eligible for cancellation of removal and most young people who have been here a long time will get indefinite stays. There are infinite gradations of illegality. In our quest to create a one size fits all solution, we have paralyzed the system. IF we just allowed everyone here to make an application without returning to their own country (which they are not going to do anyway), and then let USCIS and immigration judges issue them visas or removal orders, we could trim the problem to a manageable size and go after the smugglers and violent criminals we really need to deport. Otherwise we'll need to do an amnesty every 25 years to clear out the backlog.

It is just that they are alien to this country. They do not belong here, were not born here. Alien. It would be like me saying that having sex with a man feels alien to me, which means it does not belong there. I am a lesbian.
