If my husband calls me out of the blue(we have not talked in 9 months) and said that he has divorce papers that need to be signed and notarized by a notary public . Do I need to be worried? We have no kids. He said that he wants to marry is new girlfriend. Do I need to get a lawyer? I have nothing in my name its all in my sister name, so that he could not try and take my stuff.

Have you read the papers yet ? Its been nine months, why havent YOU filed for divorce ?

If you both sign the papers and get it notarized it would be a easier and faster process for both of you. Why drag things on longer then they need to be. Read over the papers and see what is stated before you sign. With no kids in the marriage it should be easy regardless of how long you've been married.
It will still be 3 months after the papers are filed that the divorce will be finalized any way.
I say do it some men wouldn't make it so easy and after all he is paying the filing fee not you so no money is coming out of your pocket so that is a good thing, right?

OK, Have him send you the papers, set up a consultation with an atty. We charge $65.00 for about an hour. Have the atty. look over the papers. to make sure there's nothing snuck into them. Have his secretary notarize them and then.

basic divorce documents are very short and straight forward and easily read...but you have the right to take a copy and review them before signing anything. Just ask that he mail a copy to you before you meet.

I guess your marriage is over and he is moving on. You should do the same. Get a lawyer and he will sort it all out for you.
