We had paid our rent late in August (there's no penalties for that) Now that we have tried to pay our September's rent, our landlord has refused. He says he wants us to move. We are on a month to month lease, and we have 3 kids and no where to go. Is this legal and is there anything I can do to stop it?

Only thing you can do is stay as long as you can, eviction legally takes time before the Sheriff comes and totes your belongings to the curb. After that it's up for grabs. Better plan on moving soon.

If you are on a month to month lease it is legal. There isn't much you can do about it.

Opinion - the landlord should not be evicting you if you are caught up and paying the current month. But the law is in favor or the landlord here.

most states require the landlord to give you 20 - 30 days notice prior to ending a rental agreement. In a month to month rental the landlord is not obligated to continue the agreement as long as he meets the notice requirements.

If he is simply ending the rental agreement it is not considered an eviction.
