I am in serious need of some information on child custody laws and I have no idea where to begin. Any help would be greatly appreciated.....If a child's parents are deemed unfit then who will the government turn to? Do they try to give custody to family members? If there is an adult sibling(25) could the sibling fight for custody?

There are several resources available to research however one main source is the Uniform Child Custody and Jurisdiction Act.
Normally the courts will keep the custody within the immediate family and especially with a family member who is willing and able to care for the child(ren) involved.

Same as with foster care if there are suitable family members then yes they want to keep them with family members. Make sure the agency knows you would like to be considered for placement. They will want to do a home study to determine if the placement is fit. The parents, although deemed unfit will be asked if they have a problem with the placement also. If it looks like you're getting the run around then I would get an attorney but usually if the environment is a stable environment there won't be a problem. The agency may monitor the home for about a year or so to ensure everything is going ok. Just make sure you're kept in the loop so you can do what's best for the children.

I have had several custody issues in my past with family members. In MOST cases the state would definatley prefer to have another family member care for the child. If you are the sibling then you have a very big chance to get at least temporary custody until the courts make their decision. It is actually very simple, you just need to contact whomever currently has the children if they have been removed fronm the home already and make them aware that you wish to take care of the child veres he/she going to a foster family. They will interview you and do a home inspection then the judge will make the decision. Just make sure you are ready for the responsibility and all that comes with the care of children. The courts will be on your side being a sibling.

I cannot answer for all states. In Texas an adult sibling could file a suit seeking custody.

it is really hard to claim unfit parent as long as they are out of jail, even druggies get their kids,,,
if they are taken away, they try to get a family member to take them if not they go to foster care
they could even turn them over to the 25 yo if that person wants them,,
IT is much better to have parents turn kids over voluntary than to get the courts involved,

call DCFS in your town and ask them this.....they will have the right answers.....good luck
