My roommate grows pot in his room. If he gets caught would anybody else in the house be at risk to be charged?

I'm a crim. attorney in North Carolina. In my experience, sometimes they will charge only the person whose room it is in, other times, they will charge everyone in the house and then let the lawyers sort it out later (probably depending on whether or not they got a confession). If it is growing, it is a felony.

You would go to jail and have to post a bond to get out. Drug offenses are serious- they can keep you from getting college financial assistance. They can take any children in the home into social services custody for drug offenses.

The same goes for riding in a vehicle where drugs are found. They often charge everyone in the car, unless they have a confession or it is found on a person, instead of just inside the car. The crime is for possession, not ownership, and constructive possession is enough- they don't need to prove actual possession, which means that if you can get to it easily, you are in possession of it.

So, my advice is to get rid of the roommate if he doesn't get rid of all drugs. Move out if necessary.

unfortunately i dont think it matters which room the pot is growing in.... you all live there and pay rent. You all will be busted. your roomate should have made sure it was ok with other people in the house before he started gardening. That is just plain disrespectful especially if he knows there may be a chance of other people being charged with posession. I'd tell him that the pot needs to go, or that he and the pot needs to go... for your own sake. Obviously you are concerned- you posted a question about this... i'd just have a talk with him and maybe you can work something out.

being knowledgeable and living in the same dwelling is a easy accessory to the fact or Accessory to the delivery of illegal substances. It can get you alot of jail time. If you've enjoyed some of it too it adds additional legal questions and if your raided and such, then forced to submit for testing, it can be really nasty. I would suggest that the friend and you part ways unless you want to spend some time in a 6ft by 8 ft cell and likely have a felony arrest on your record. and please dint claim "ignorance of the law, as it is no excuse." *that's actual law text*

also remember your property such as your car and other things could be seized if they can show or prove it was likely used or suspected of being part of a illegal drug operation.

It depends on which state you live in. Most states will throw everyone in the house in jail. Then the one who rats out his friends gets to go free and the rest spend 6 months in the big house.
If I were you, I'd pack up and move.

If he claims you knew, he'd have to say no one else knew what was in his room, it's the same as driving a car with someone who has put pot under the seat, you get included, it's best to make sure your name and his are under seperate leases or only under his name. If police do come and they know who they are after they will only take him, they souldn't take you unless someone says you are also growing and selling, make sure your room, mate won't sell you out

Laws vary state to state. Generally, if you say you didn't know about it, they'll leave you alone. Still, a roommate has to respect your concerns. If you don't feel comfortable with the situation, let him know.

If you know then you are in trouble as well as him.

If you know then Tell him to get rid of it. It puts everyone over the age of 15 at risk for drug charges

yes. everyone whose name is on the lease is responsible for the activities that go on in the house.
