My brother, 24, is in the USCG. His wife of about one year, 19, is living with him and their three month old son in Missouri.

My brother was on the boat for a week, but got home a day early. Make a long story short, he caught his wife cheating with another man.

My concern is that the wife has always exhibited erratic behavior and we have reason to believe she is bipolar. I fear for the baby's safety because she may do something to the baby if she feels she's lost her life and marriage.

What can my brother do. This all happened yesterday. He's staying with a friend and she's is out of the house, probably staying with this other man.

if they get a divorce, show them pay stubs. i'm assuming he makes more money than her, but that is me being biased on age. money has a LOT to do with custody.
on top of that, try and prove that she has a mental condition, however that can take a long time because she can find doctors to fight it.
money (security) is your best bet.

Money has absolutely nothing to do with custody. Safety of the child does. A parent has to be proven unfit in a court of law before a judge will award sole custody. Most days, joint custody is awarded. A mental condition is not enough to get sole custody unless the child is endangered by the parent.

ASAP...will take a long time. The burden of proof that she has a mental condition would need to be established. He could file papers and hope to get temporary custody while tests were being done.

Talk to social services, get someone to investigate the mother and see if the kid is in danger. If so, he'll be removed. Unfortunately, you can't do it legally in a day.

On the other hand, she was the one who cheated, why does he have to be the one that leaves the house and the baby? she should go and leave him with the kid.
