No that is not true. The electoral college is the one that has final pick the president. The vote of the people is just a cover up to make you think you are picking the president.
Example:
In the last election Bush was picked by the United State Supreme Court. Total unconstitutional. If you remember the Supreme Court ask (WHAT IS THE FEDERAL QUESTION)
There was no federal question and so the Supreme should not have heard the argument. It was a state issue not a federal issue. Bush was unlawful placed in office. However, the one running against him wasn't any better or worse. Perhaps!!

Can be true. Chain of command eventually leads to Congress to appoint a President in extreme incidents when the Executive Branch is decimated leaving nobody to take the oath. You'd basically have to nuke D.C., Andrews (before Air Force One made it off the ground) and Camp David. Beyond that, enough of Congress would have to survive to actually make the appointment. In other words, not going to be a common practice.

When the vote is even (electoral votes), the U S Senate will vote for the Vice President and the House will vote for the President; which means we could likely get a Democrat and a Republican in the White House.
Are you betting that this will happen in 2008? I hope not, so far it looks like Obama is heading for a landslide.
