My condo's HOA is full of rude and slow, lazy people. They do nothing much for a lof of fees. Our HOA fees are $206 dollars which is a lot for a complex of our size. I would like to know how I can get rid of them. Petitions? Etc? So then we( the residents ) can get a new company to run our HOA.

Has anyone ever done it??

I'm on the board of an HOA.

You have to get enough residents to petition the board of directors to call a special meeting to specifically discuss the performance of the management company. it should all be in your document how to do that. Plus a lot of states have specific laws regarding HOA's. Once the meeting is called, you all need to show up. Tell them in advance you want to see the contract with the management company so you have time to prepare your arguements. You then have to make the motion (and have it seconded) that the Board of Directors hire a new management company when the current contract expires. That forces them to act.

If it's your board of directors that is the problem, that's a different issue. But then you have to elect people who will act. Electing directors who will hold the management company to a higher standard is possible too.

As a last resort, you could get a group of people together and hire an attorney to separately represent and review how things are going and recommend specific actions.

But as far as the fees go, you need to look at the budget to see how things are broken out. You'd be shocked how much some things cost. Especially in condos. You're paying for long term reserve funding of parking spaces, siding, roof repairs, etc.

The HOA is basically a cooperative. the decisions are based on the homeowners of the properties in the community.

To change your HOA, you would have to get a petition according to the HOA rules, have it voted on by all of the HOA members. Depending on the rules of the HOA, if 50% - or in some cases 67% of the owners agree, then the HOA can be dissolved or replaced with a new HOA.

First you need to get a copy of the HOA by-laws and read them very carefully, especially under the parts dealing with modifying the HOA.

If there are any questions, your only true recourse is to take your peoblems to a lawyer knowledgeable of real estate law

Don't assume that $206 dollars is allot of money to run your complex. There are expenses that come with running a condominium complex that you may not be aware of such as, water, trash, electric, ect. If you have a pool that is additional fees. They are also required to set money aside in reserves for future project or in case of a emergency. Your time to petition is yearly when the new board is voted in, at this time you can volunteer your service and become a board member

Board member for 13 years at my association.
Heard all the grumbling for homeowners but when it came time to vote us out no one wanted to do the free job. So the lazy homeowners kept voting us in.

If you take the direct confrontation approach, you will get them all upset with you and you will probably lose.

I would suggest that you take your time and start out by trying to work with them. Meet them and see if there are any good people on the Board. Try to get on the board. Ask to see the bylaws. Ask to see the minutes of meetings, etc. The bylaws may tell you how members can be removed, when elections are held, etc. You probably have legal rights to see the bylaws and the financial statements. I believe that you will be much more successful if you work slowly, build allies, follow the bylaws, and took to be successful in a 3 year plan rather than all at once.
