The car in front slammed on the brakes, I "scuffed" the rear bumper and 2 very minor scratches that can be removed without taking to the shop. Of course they are trying to suck out the money out...there was no police report and no witnesses, she did get a hold of my driver license and insurance though. She is now however trying to get all the money she can out of me saying that she needs between $1,200 - $1,600, when her car does not need a bumper replaced! What can I do? I feel it's not resanable.

You are responsible since you hit her. You also should have insisted that the police were called. Not much you can do at this point except turn it over to your insurance agent>

Research online and ask around for how much does it cost to get a new bumper for her car ... Which I believe she does not need one!

Tell the insurance company to WAIT and not give her any check or money until THEY show up at her work or her home and check the bumper to see how bad that is! ... OR if you have her address and you or a friend can go by her home and see if the car is on the drive way and take a picture of it and show it to the insurance company saying it was only a S-T-R-A-T-C-H and willing to pay for the paint job itself !

What a rip off that other person tried to get a new bumper ... I HATE when people say you ruined the bumper I need a new one ... Come on I have let 2 people go when they hit my bumper and we'd look at the bumper and I'd see one or two stratch and I'd say its ok I can get the paint off and if the other person was okay with it ... I even hit other car and her bumper actually fell off and she was so nervous and said dont tell the insurance company I can't afford it to go higher my hubby will fix it and dont worry and I said its my fault I hit you ... She just said dont worry and left ... I looked at my front bumper and there was NO dent NO stratch I was amazed! ...

P.S. Her insurance will still go up anyway cuz the way she drives reckless and caused you to hit her ...

hi I worked for a Police department and for any accident however small you need a poilce report .... It doesnt stop people trying all of this.. but what you have to remember is this... the scuff on the bumper and scratches dont show what happened wen the bumper pushes against its mounting bracket... These are feeble and can bend out of shape.
Question....is she claiming this off your insurance or are you paying out of pocket??
The police report would have put an estimate of damage... but is isnt a quote to fix it...
Also i can tell you know that the next thing will be claims for whiplash injury... that the real reason you should always get a police report. However... If you had you would have been given a ticket for travelling too close to the veh infront..
But at least the cops would have put on the repor tno injurys on scene requiring medical assitance.
You could say to them that they can deal with your insurance... either way you are going to loose out in the long run... 1,600 out of pocket now and if it goes through your insurance .. proablily that amount added to your premium for the next few years...
crappy situation I know...

Most states have a cap limit where you must file a report. If you just scuffed the bumper, buff it out with a shammy and some wax and don't worry about it. Check your state's laws for the amount of damage where you must claim for future reference. It shouldn't cost anything to fix a scuff (maybe 2 cents in wax). But no matter what, even if you nailed the guy in the rear at a red light going 90, NEVER ADMIT FAULT. Admiting fault gives him reason yo sue. Don't even apologize. Just make sure he isn't hurt and trade information if it was serious enough.

That's why you get police reports. Now half the bumper could be ripped off and you can't prove it wasn't part of the damage you caused. Besides If She slammed the breaks on she could be at fault. Tell her to go ----------------------. Was it her Idea to not call the police? She might have a record of insurance claims from people hitting her cars. Carry a disposable camera in your car from now on.

she has no proof it was you or that you were even around to do it. i got hit a while back in a work truck by someone in a work truck, popped my back tail light and housing, didnt file a police report. at the time, he was saying how he had insurance and all that. afterwards he tried putting the blame on me. nothing we could do.

1200 and 1600 is a load of BS if you ask me. i got wrecked (another time, got rear ended) and my hatch was all smashed up and dented and messed up. after all insurance was said and done, it was 800 ish to fix and paint. so there's no way 1200 to 1600 can be necessary for 2 scuffs. even a new bumper.

Your insurance deals with these matters, at no time are you responsible for paying out of pocket for accident expenses. Technically you are 100% at fault because you did not give yourself enough stopping distance depending ont he car 1,200 is quite reasonable for a repair as a dented bumper severely effects the integrity of the bumper itself and even if it looks just like a scuff mark the material underneath could be completely destroyed, if she contacts you about paying out of pocket tell her to make her claim with your insurance company, yoru insurance will go up but that will be the lesson you learn for following to closely and feel lucky that you didn't get a ticket for failure to yield.

As you now know, get a police report. they're are people out there that make their living by slamming on the brakes and having someone rearend them. They file for damages and then the medical claims. The report would give a history of accidents that she has had being rearend. You could say that she did it maliciously and it was her fault.

Let the insurance company fight it, that is what you pay them for. give them a call tomorrow and explain it to your agent.
