My daughter lives with her father and she really wants to leave. He doesn't provide for her and doesn't take care of her. ie. taking her to the dr. or dentist...
She is now having extreem difficulties in school, mostly due to him not providing her with new clothing and supplies. I have contributed to her new schoool stuff but only half to see if he would provide the rest.
She wants to leave his home and live with me (2 hrs away). I want her to be with me, but have no extra money for a lawyer, but will get it if I have to. I just want to know what I can do immediately, given her age.
I have let things go for a while because I think her education would be better where she is, but it's not so important that I'm willing to let him continue to neglect her. I will do whatever I need to do at this point.

If you took it to court, or he did, they most likely would give your daughter the choice, given the circumstances. But go prepared for a fight. Unfit parents, even if it's best or they don't want the responsibilites, don't want to be showed they're unfit, and there's always the parents who want to one up each other. Don't make it a big mess, choose a good plan as quickly as possible and stick with it, it's best for your daughter. Kids need stablity and to feel safe. And you seem that you just want what's best. I was in the same situation, but I was the kid. It's hard, cause it's your Mom and Dad and you want to please both, plus being 14 is hard enough, not having to worry about having school stuff and clothes. Her school with probably have to be changed, given the commute, but maybe she needs a fresh start, because her enviroment with be different. Talk to your ex about maybe him having her on weekends and you for school.

Lot's of things to consider here. Are you sure he doesn't have custody? If there is a child support order in effect, then custody has been established. In either case take it front of a judge, especially if he is contesting, you could go to jail for custodial interference. The Judge will consider why she hasn't been living with you all along. So make sure you have your life straight.

Talk to him and tell him that your daughter wants to come live with you for awhile on a trialbasis to see how things would work out and go from there.Youll have to talk to him sooner or later so why not in the beginning?

If there is no legal custody agreement then you have just as much right to have your daughter live with you as her father does. It isn't likely he can get sole custody unless he proves you unfit.
