If the rapist killed the person he raped. Then yes - death penalty.
If the rapist did not kill the person he raped - then no. Lock them up for life and don't let them out - but spare their lives.
If rape became a death penalty crime, then more women who are raped would be killed. The last statistic I heard was 1 in 4 women are rape survivors. The death penalty would not be a deterrent to the crime. Rape is a crime of power - the people that do it are not thinking about the consequences for their actions.
As far as the male/female question goes - rape, by and large is a male on female crime. Sometimes, men are raped by other men. Very rare for a female to rape a male.

Well, technically, yes. Think about it: there's a big difference between "cruel AND unusual" and "cruel OR unusual." Our laws say "and," so therefore, obviously, the death penalty for a rapist doesn't happen, so it would definitely be unusual.

Did you know that a number of people have been shown to be innocent after being convicted and sentenced to long terms for rape with DNA evidence? There are dozens of cases of men found to be innocent of rape with DNA evidence who were incorrectly identified. This includes a substantial number of incorrect identifications by the victims.

no DP, i believe that no matter what the crime is instead of the justice system putting the inmate on death row they should take them out and someone do the exact same thing to the inmate as they did to the person that got them put in jail in the first place, if its murder, then do them the same exact way the only difference that there should be is if the inmate murdered someone quick, the inmate should be tortured the exact same way. thats my oppinion do to them as they did to others

No.....not for rape, don't get me wrong...I hope they sit in a dark hole for years if they are convicted in a fair trial, but the death penalty its just too extreme. I am in favor of the death penalty in a myriad of different kinds of charges........but rape is one of those things that girls/or even boys, can still lie about. There is almost no difference from real hardcore sex and an actual rape, and to kill someone for raunchy sex is just a little over the top.......don't you think?

well raping someone is horrible, and it can damage someone for life.
but then again, who are we to take someones life?
they will die when they are meant to.
we can't judge them, we may not know the whole story.
So i guess i'm against the death sentence.
even though most of these people are horrible criminals, and they probably deserve to die, we shouldn't be able to judge them, because us as humans make mistakes, and we all do things that are wrong.
plus if he is in jail for a long time, he will be able to think about what he's done.

death pentalty seems pretty harsh for rap and before any of you freaks start saying something I was raped!
But he seriously needs never to be in a position that will allow him to do it again. if its house arrest for the rest of his life then be it. Also he should pay for all the legal fees on both sides, serve time, and be required to seek pshyetratic help at his expense.

Depends on the circumstances, there are lots of shades of violence in this crime that create different situations.
Of a child, with violence and torture, I'm all for it. I'd pull the switch myself, for free, and not regret it for an instant.
