18 months ago my employer was paying me less than the minimum wage can i still make a claim against him or is it too late

There is a 6 year time limit on all things financial in the UK. If he doesnt pay up, report him to HMRC. This is not an employment matter, but a tax matter as NMW comes under the juristiction of HMRC.

Ask someone at the employment security office in your state. Every state has different rules. Many states allow an employer to pay less than minimum wage for tipped employees. Additionally the minimum wage for minors is often less than that for adults.

It will be classed as unlawful deduction of wages.

To Use the employment tribunal which is quicker and cheaper you need to have a claim in within 3 months of the last date of incident (your last pay).

Unfortunately you are out of this.

Your next and only option now is the County Court using their small claims procedure. It has costs attracted and it will depend on the amount your are claiming at what level they will be set. If you win, the defendent will have to refund you. If you are in receipt of a benefit including tax credits you may be able to waiver the court fee

BEFORE you go with this....you must write to the employer first and ask for the wage difference to be paid. Keep copy of letter. He may well reply with payment...which is all you wanted. He may ignore or argue your request.....thats when you go to the court

The judge will reflect in his decision that you tried to resolve the issue before it got to court

NB Make sure you have your facts right. Check your age at that time against the min wage at that time (min wage is increased every october)

You can still fille a clam. You just need to have the pay stubs from the checks with less than minimum wage on them.

There might be a statute of limitations of less than 18 months in your state, but more than likely you can sill bring suit for back wages owed.

Make the claim. It is probably not to late. Unless you are currently working for the same employer or expect to get your old job back you have nothing to loose.

i think the time table is 2 years but you should talk to the unemployment office in your town
