2nd amendment - a well regualted militia, being nesessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed.

a. brady handgun violence prevention act - a five daywaiting perod before purchace of a handgun and a national instant criminal background chekc/ liceneced gun dealers are required to check the background and each gun sold must be ID'ed by number.

b. volience crime control law enforcement act (1994) - bads the manufacture of 19 types of military assault wepaons and prohibits sale and tranfer of a gun to juvenilles.


QUESTION: does the federal law (point a and b) violate the 2nd amendement of the consitution of the united states? explain.

A) No. This still allows citizens to bear arms. This just lets the government know you own one in case you decide to commit treason or something.

B) No. I don't think guns were ever meant to go into the hands of minors. And the guns that are banned from public use are for the Military ONLY. Citizens aren't allowed to own those guns. When the constitution was written, combat guns were the same as hunting guns.

A is OK because it is reasonable that criminals not be allowed to posses guns.

B clearly violates the spirit if not the letter of the 2nd amendment. It doesn't say we are allowed to possess muskets. It was meant to allow the population to protect itself from a government that became to oppressive. Assault rifles are consistent in that spirit.

a. No, it does not stop someone from owning a gun.

b. No, the 2nd amendment was never intended to apply to juveniles.

a. Probably not because you just have to wait to get a weapon , this doesn't prevent you from getting one.

b. First part yes , second part no.
