i haven't gave birth yet, but am wondering about the father of my baby, i locked him up and i now have an order of protection againts him..so my question is if he tries to get rights once my baby is born next month,and once he's out which is also next month..what are the chances of him wining any rights at the family court?

It is not a case of him "winning" rights. When you allowed him to father a baby, he gained the rights. The only thing you can do now is have some of those rights taken away.

Different jurisdictions look at this differently. In general the child has a right to have both parents in their life unless it is not 'in the best interest of the child'. Usually, commiting domestic violence against the mother is not a reason to keep them from the child.

If he gets out and complies with all the courts orders -- he should have been ordered to anger managment, to stay away, etc -- then they are likely to restore his rights to see his child and to have joint legal custody. It is very rare today to give one parent sole custody although visitation may be supervised for a while.

No one can really give you any more than a guess on this website, but since he's locked up, the chances aren't good that he'll get custody of a baby. You need a lawyer. Fast.

you didn't lock him up, the police did. Plus, as the others said, he already has rights if he is the bio father.

you have a better chance if what he got locked up for is true like say he was accused that he stole somthing but he didn't do it (this is hypothetical) and you accused him of it and he didn't win ( still in hypothetical mode) then when he gets out and they find him not guilty *SHABAM* he gets 1,000 dalores and a better chance of winning a case.. but if he did do it you have a better chance..Hope This Helps
