I think you can cut down trees if they are on your property?Are you not close with neighbor to walk over and aks how she feels about you cutting it down?does it provide her shade or something?I cut /trim the ones way back that are going over on others property..due to legal issues i live in fla and we have hurricanes i dont my tree on top of their stuff!!

If it's on your property, it's legal - possession is 9/10ths of the law and if the tree branches (or anything else) is on your property, it's yours to do with what you please. If there are parts of the tree that are on THEIR property, you can't touch those!

You can cut down that portion of the tree that is on your property. You own from the center of the earth to the heavens [subject to mineral rights previously conveyed in the chain of title.]

If the tree is on your land, and by that I mean that you own the land (not renting or just living there) then it's your tree.
Check with the local code office before you cut it down. In many places, erosion control and environmental laws restrict cutting down certain trees.

If the tree is growing out of the groundon your propert, you can cut it down from the base. If it is growing over ONTO your property, you can only cut off the overhang.

Technically, you can if it's on your property, because it would technically be yours. However ... ever thought about talking to her about it? It could make Thanksgiving at your house a little uncomfortable.
