If you are being deposed, almost anything that you might say could be the basis of a claim being brought against you by one of the litigants. So you should seek to be represented by counsel when you are deposed.

If your employer or someone else is the party in interest to the litigation do NOT assume that its counsel will represent your interests. Get your own lawyer who will look out for you.

It depends on what the case is about and why you are being deposed. If you are a party to the case (named as a plaintiff or defendant), it's definitely a good idea to have a lawyer present -- or at the very least, advise you about your rights before you testify.

While it is not necessary, it may be a good idea. If one is being deposed, one is being questioned by an attorney. The need for concil depends on the situation. if the person feels that they are being accused of something, they should ask for an attorney. Otherwise, they may proceed at their own comfort.
