Can they garnish your wages and if so how much can they garnish?

If you own stock or have an inheritance can they get that?

And if you don't show up to court can the person sue you for not showing up.

I was in a car accident with this guy. I was driving my mother's car. She is being sued also but had nothing to do with the accident. I am being sued for bodily injuries and car damages. I am employed but I know I don't make enough to afford a lawyer nor do I make enough to pay off his judgment. The car I was driving had no insurance, that's why he's suing me. WHAT do I do in a situation like this? This is my first accident. And I'm very unfamiliar about how the laws work in a case like this.

I would like to have a lawyer or someone who has been in a situation like this to give me some answers or advise...or just an individual

Yes, if the judgment is not paid they will garnish the wages of the person found liable.

You're lucky you weren't driving up here in Canada without insurance. Do that here and get caught, I think it's a fine and/or jail.

I'm not sure of the amount allowed in the U.S. In Canada, it's 15% of the second $1000 net pay (take-home) each month for credit card debt. That's not more than $150 per month.

In most states they can't touch inheritance or stock if you have already put it into some sort of retirement plan. Otherwise it is probably fair game. If you don't show up, you will likely get a summary judgment against you or you lose to put it differently. Why would he sue you for making him win the case assuming there is some basis.

You need to go to the court and say what happened. He can't get blood out of a turnip. You will probably have a judgment against you that will cause you to have to pay money. It may be possible to go bankrupt. You will probably need to get the advice of a lawyer. (not a lawyer)

Getting a judgement against someone is no guarantee that a single penny will ever actually be collected. It is only a judicial finding that one party owes something to another party. Depending upon the state in which you live (as well as who got the judgement against you), there is likely to be a fairly lengthy list of property that cannot be touched, as well as a long list of property that can be sought via the judgement.

Your possessions can be impounded and sold off to pay his bills, fail to pay can also mean prison time.

Its your own fault for driving without insurance.

Garnishing your wages is a term used when they ADD something to your wage packet and not when subtracting from it.

In your case looks like you will be living on lemons for years to come.
