and her mom is possibly going to be charged with murder because she could had prevented the accident. She will be charged under a British law that will make the punishment just as severe as if she dilbertely did it.

What is this law and why would you hold someone liable for an accident? I mean accident's happen every day some more severe than others but does that mean if my child jumps off the bed and hits his head and I have to take him to the hospital I'll be charged for it?

Many accidents are preventable thus the term Negligent Homicide. You leave a small child unattended in a yard with a pool and said child falls into the pool and drowns. Is it an accident? No. It is the result of negligent behavior where the individual being charged should have foreseen the possible death by drowning of a young child unattended child.

Much depends on the child's age and the circumstances.

You do not cite the case in which this allegation occurred or provide a source.

If it is because the parent is negligent in caring for the child, then yes, they can and should be charged. If you have a 2 year old and no saftey gate installed and your 2 year old falls down the stairs and dies, you could be charged with manslaughter.

yes some "accidents" could amount to criminal negligence, especially if the person is charged with the duties to take care of the victims. examples are like parents-child and also with carers of people with disability.

that said, i know of a recent case in australia where a two week/month old baby was left sleeping in the cot in her room but mauled to death by the family's huskies while both parents out sitting in the lounge watching tv. none parents were prosecuted. only the dog had to be put down.
