The lithosphere includes both the crust and the mostly rigid uppermost mantle. The two layers combine to form the tectonic plates, which float on the hotter, more fluid, deeper part of the upper mantle.

The two parts of the upper mantle are chemically the same (which is not true of the upper mantle and crust), but differ in temperature and rigidity. But only the cooler upper portion is included in the lithosphere.
