We are all salaried associates, our pay-stub says we are paid at 40 hours yet typically work 55 hours. The company requires us to work 50, at least. The company is selling so we don't have to worry about losing our jobs.... the new owner has made us job offers.... Do we have a case? Any support appreciated. The State is Florida.....

No; you would only have a case if you were an hourly, or non-exempt employee.

As you are a salaried, exempt employee (meaning the employer is exempt from paying your overtime) you agreed to be a salaried employee when you accepted the position.

As you indicate the new owner is making you job offers, keep in mind that if your past employer expected you to work at least 50-55 hrs a week, the new owner will likely do the same and keep that in mind what pay you are willing to accept for working that many hours in a week for a set salary.

If you're required to work 50 and the stubs say 40, that's a pretty clear case. If you have been invited to join a class-action, chances are that someone has already talked to an attorney and gotten a real estimate of how good the case is and how much money is involved. You definitely have a case (but who doesn't?) so talk to a lawyer, because any estimates you get here will be pure speculation.

Salaried employees are paid a 'regular salary' and not an 'hourly wage' ... so it doesn't matter how many 'hours' you have to work ... and you do not have a 'legal case' and neither do any others who work for you company.
