In real life, Alan Cumming's part in the movie was minor compared to X-Men 2 during the early drafts of the script. The production staff realized that it wasn't worth the time or money to have him sit in a chair for up to 10 hours a day to put on the extensive makeup just to revise his limited role, so they wrote him out of it entirely. Alan Cumming was ready to reprise his role and even made announcements to the press about when he expected to start filming, but then he suddenly put out a message on his official website that Fox decided not to pick up his contract option for the new movie (although he didn't provide a reason at the time).

The storybook reason that he didn't appear in X-Men 3 was revealed in official X-Men 3 video game which had a story written by one of the X-Men 3 writers and Chris Claremont (the longtime writer of the X-Men comics). Basically it comes down to him not wanting to remain with the X-Men because he feels that he would be forced to do things that he doesn't want to do (mainly physical violence).

The actor, Alan Cumming, who played Nightcrawler refused to return for X3. That is the reason nightcrawler leaves at the end of the X-men 3 video game (the game was a prequel for the movie).
