I found this really interesting. The reason given EVERYWHERE as to why the fund was not a charity was that it was refused charitable status because it didn't represent the good of all.

This is a lie - the Charity Commission gave advice, but they chose not to take that route. We all know what route they took eh - right to their very own limited company!

"The Commission was quoted in the article as saying the money raised was not for the “wider public good”, but has told Charity News Alert the story had been “misreported”.

“We were first approached for our advice about the possibility of a fund to assist the parents’ search on Monday 14 May,” explained a spokeswoman for the Commission. “We held discussions with the family’s lawyers and in the end they decided not to pursue that route.”

When the Fund was first set up I pointed out that this could be used for the 'benefit' of the McCanns if they had to defend themselves in Court against child neglect or any other charges which may be brought in the future. This has been set up by experts and I cannot see how it can be stopped unless the fund is frozen. It was obvious from the start that the money was to be used for the benefit of the parents and I cannot see how any of it has been used to find Madeleine. The Fund must be frozen, this has been a blatant scam from the word go.

Charitable status is not always the most efficient way to deal with a non-profit fund. There are other legal incorporations that can be used, such as a company limited by guarantee with no share capital - a status that protects the principals of the fund from personal liability in the event of the fund going into debt, but prevents them from benefiting personally from the fund when it is doing well.

I hope the McCanns are judged on solid evidence, not on the speculation of the media and rumour. Their new status as suspects effectively gags them - they will now be prosecuted if they speak about the case. Unfortunately it does not gag the press, who sell far more papers if they spice the story up with inuendo than if they tell the straight facts.

Thanks... That is a very interesting detail I did not know. How many more details like that are there.... ??
Also... hasn't Scotland Yard say in the past something like "When a child has been missing for more than 48 hours it is unlikely that the child will be found alive !" -- Yet everyone was very surprised when, after 3 months, the Portuguese police say that Madeleine is "probably dead" ! ???

I'm still on the fence regarding the Maccanns - just the thought that seemingly responsible and respected people may have killed their own child. They are obviously a very selfish couple - but is all of this a case of the press wanting them to look guilty and so finding any information against them to prove their point? Having said that if they have possibly accidentally killed Madeline and tried to hide the truth for their own selfish sakes, they deserve more than they will probably get.

I thought it was strange that the Charities Commission would not set it up as a charity. I am a Trustee/secretary on a county wide organisation, and we have a Limited company by guarantee/charity. All our funds have to be spent on the community to benefit them. We have a Limited company number and a registered charity number.
The McCanns are nothing but criminals.

if i were the mccanns i would have done a charity...then if the worse happened that money could be given to help other parents....not go in my back pocket or to fund legal advice

It is quite a long process to apply for charity status, IF they are innocent it my not of been the most important priority at the time.

They would not be using it for lawyers if it had been a charity from the start,

makes you wonder if this was planned before they went on holiday, judging by all the events thus far.....

edit can you see the motive here? set up a money pit, to spend as they wish! clever way of avoiding a ransom plea
