If someone does not have a disclamer or a copywrite and they freely post it over the internet could you resell it to someone else legally?

Once a work is created, it is copyrighted and it is illegal to copy it without explicit permission.

Once they post it, they have copyright protection on it.

So you should go make your own amateur porn to sell.
