Companies sometimes offer maternity leave, but it's not mandated by federal law. For the most part though, they are required to treat maternity like any other temporary disability. Some states might have laws abou it, although I don't know of any, and you don't say what state you are in.

The FMLA is federal law as long as you are covered. They don't have a choice about offering the leave, but don't have to pay you either.

There are no laws regarding maternity leave specifically. The FMLA (not flma) is the Family Medical Leave Act. According to this they have to treat the recovery time after the birth of a child as a short term disability. They have to give you 12 weeks to return to work according to federal law (some states have different laws such as DC is actually 16 weeks).

Now if you have benefits such as Short Term Disability (which some employers offer) you may also be covered. You would have to check specifically with your job or you can search the web to see if you can purchase Short Term Disability as an individual.

It's usually up to each employer to decide what maternity leave and benefits (if any) they extend. If they do ofer benefts I may run concurrently with FMLA or in addition to FMLA.

Check with your state's dept. of labor to see if there are any labor laws around maternity leave.

Some states, such as CA, offer pregnancy disability leave (PDL) in addition to FMLA. Most states offer FMLA only.

In addition, leave policies vary from company to company. Check with your HR department to see what they offer.

the disability law check with your work place and fill out disability plan my sister had this plan and filed it she is on leave with pay for disability she had her baby three weeks ago (disability because you can not work because of pregnancy)
