what is the jail sentence for an adult of age 22 dating a girl of age 17 that is soon to be 18 withing months. If chargess were press against him by the mother what is he looking at spending in jail . What if the girl dose not want chargess pressed against him and if he was sent to jail can the girl remove chargess once she truns 18 or what would happen?

Normally, when you hear of males dating females the age of where one must be considerably concerned is when the female is under 16.

According to the websites I've researched, California Age of Sexual Consent is 18.

My strongest suggestion is you abstain! The girl is still a minor and therefore it would be her parents who filed charges against you not the girl!

Sentancing depends entirely on your state and the circumstances of the case. There are sentancing guidelines, being a maximum and a minimum which the judge works with.

A persons age, previous record, work or education history, as WELL as victim statements (like the girl) are taken into account when the judge decides the sentance.

As far as her retracting the charges when she turns 18, I am sorry to say that that is an interesting question that I do not have an answer to.

§ 261. 5(b)-(d)
Anyone who engages in an act of unlawful sexual intercourse with a person under age 18 and the actor is not more than three years older or three years younger, is guilty of a misdemeanor----Up to one year in county jail

Anyone who engages in an act of unlawful sexual intercourse with a person under age 18 who is more than three years younger than the actor is guilty of either a misdemeanor or a felony --- Up to one year in county jail or by imprisonment in the state prison (period unspecefied)

Any person 21 years of age or older who engages in an act of unlawful sexual intercourse with a minor who is under 16 years of age is guilty of either a misdemeanor or a felony

in california it doesn't matter if the girl doesn't want charges pressed against you - if the mother does, you can end up with a sex offender charge that will follow you for the rest of your life.

if she's going to be 18 within a few months, why not abstain from sex until then so you don't have to worry about it. if you really care about her, what's a few months? if you just want to get laid, there's plenty of girls out there who are legal.
