Technically, if it's licensed in your area, even if it wasn't downloaded, it's still illegal (for them).
And I think you're confusing fansub for a "Scanlation." Fan subs are actually subtitled anime. Like Naruto Shippuden. Though Naruto is licensed itself, people still download the series because the US hasn't caught up to the season that's showing in Japan. And though Naruto is licensed, people still download the classic series.
As for being caught, it's a rare occurrence. If at all, I supposed you'd be fined a lot of money, and with possible jail time for copyright infringement. And that's if charges are filed against you.
Have you seen the Harry Potter incident where the kid was translating the book in his country? He was arrested, but the author didn't file charges. She let him go. He was quite lucky.
Anyway...I looked up the site, and lots of these series have been licensed, and the company who published these books are not making profit, because leechers like some "Fans" have been reading for free.
xD Sorry, I buy my manga. Bleach, Naruto, Fruits Basket, and other titles listed are avaiable in your bookstore. Check FYE, Borders, Waldenbooks, Suncoast, Barnes & Noble, the official publishing sites...
So... I think people can right click and still save the files, regardless...so technically, yes. But either way, I think there are more important things to arrest people over... >.>;

The people doing things like DBZ Abridged and Yu-Gi-Oh Abridged have permission to do their shows.
