not legal...i think in any state....check out labor board and go in armed with info....bear in mind in doing so...they may find they no longer need your services.....Yep..that's how it works....sorry :-(

Sounds like it is time to look for a new job.

Above posters that state that it is illegal and that mandatory breaks are required are wrong.

Most employers do allow breaks and lunches because studies have show that it refreshes employees and they are more productive.

As much as it sucks, unless your State has laws about breaks & lunches (few do) under federal law, there is no such thing an employer being legally bound to give you any breaks or even a lunch break.

Your employer can successfully argue that they are not giving you a "break" by allowing you leave your post for no more than 2 mins if you have coverage, but merely allowing you to go to the bathroom if needed and not excessive.

I've not heard of an employer not giving a lunch break and another small break when working that many hours. You need to check with wage and hour/labor department and perhaps they can give you some insight as to what is legal and what is not.

law required that you have at least a 30 mim lunch and two 15 mim breaks..he might fire you but you could make it bad for him by reporting him as this is abuse. i am sure that he knows that but is trying to intimidate you.

this is illegal, you have the same right to have a break, and a meal time like any day worker.
