Just in theory, since citizens are able to issue a citizen arrest in the witness of a crime, if I saw a police officer breaking the law..i.e public intoxication..could I pull out my pistol and say "freeze scumbag"?

well I see he has to be commiting a felony. So if I seen him taking a bribe from a drug dealer..

i'll go out on a limb here and assume you are black/not white from your avatar. that mixed with you pulling out a gun on a cop will not end it good results. hell, even a white person would get shot to bits.

Its like this, if an FBI agent is rushing via an intersection, basically to speed, no genuine reason, a sheriff, or possibly a deputy could desire to pull him over... yet another occasion, a police officer is going on a killing spree and kills a pair human beings if he's a familiar police guy, then a deputy ( a decrease form of a police officer) can arrest him. A fireman could no longer arrest a Police guy yet he could desire to detain the police guy. Even a familiar Citizen if looking extra healthful could desire to place a police officer decrease than voters arrest!

Depends on the circumstance, if a police officer is undertaking an activity that is potentially dangerous to the well fare of the people around then a logical legislation will authorize all citizens in the vicinity of the action to help stop the damage and why not help arrest or immobilize the source of danger even if it is a police officer. After all a thief can put on a police uniform!

If your jurisdiction allows you to make a citizen's arrest, then you may do so. Otherwise, you can be charged with aggravated assault on a police officer.

Public intoxication is not a crime, but a misdemeanor offense. A citizen cannot make an arrest in these circumstances, and would be subject to full civil and criminal penalties.

Pulling out your pistol on a police officer makes you a legitimate target, and if you are injured / killed in the event, there can be no civil or criminal case on your or your family's behalf.

Well, I generally wouldn't advise pulling a gun on a cop, whether he was breaking the law or not. That could end badly.

However, every police department has a complaints department, and in most cases, an internal affairs or other "report a bad cop here" office for citizens. Contact them first.

Anyone who says there is no crime involved with a PI is lying. Since it would never be a good idea for you to personally attempt anything like this it is not recommended. For any human being on this planet it is a MAJOR CRIME to mix alcohol and firearms. Since cops are on duty 24/7 you can bet he is armed. Your best bet is to call the cops on him and inform them that he is a cop and therefore likely to be armed. His judgement was clouded to start with. Most cops I've known have always gone out of town to drink. Regardless, it is still a crime.

Yes, you can perform a citizen's arrest on a police officer. Remember that he is allowed to carry a weapon even when off duty.
I don't think you want to tangle with a drunk with a hand gun. Better to just call the police and report him.

lol I would suggest you don't do that. Just because unless the cop is currently being pursued by other officers, no matter what has happened most likely the cops will come to help the officer that you detained, regardless of what happened.

only if he does not follow procedure (reading your rights) or sexually violating you etc. free ticket out but you can't Sue for money unless it is the government for fauls arrest witch can only be done if you get sentenced.
