It has a redish body and a yellow back (the hump of the spider). The yellow is very bright. Also it has black dots all over it. even the legs. Is it poisonous?

Where are you? There's a male Golden Orb but he's in Oz.

This time of year the Orb spiders are getting pretty big and become noticeable. Does this spider make a nice even web? Orbs are known for this. All spiders have venom, it's how they kill their dinner. Toxicity varies greatly, from mild to, well nasty. Orbs aren't deadly at all and they don't want to bite unless your force them to. Give them their space, they've been eating bugs in the garden, let them finish before winter when they die off.

I'm thinking it's an Orb too. The next time you see an unusual insect, take a picture on your digital camera--if you're able. Then you can send it via e-mail to an Entomologist's site and ask them! Here are some links to show you what some Orb's look like.

Sounds like it might be one of the color variants of a garden spider (Argiope aurantia, or maybe A. apensa) They're harmless to humans.

With a little more information about where you are and where you found the spider, we might be able to do a better job with id.
