It's a deposit to hold the apartment, i dont want to move now.

On top of that I never got a receipt or signed anything when I handed them my check.

Probably not. That is the whole point of a deposit--they take if off the market for you. They've lost that time that they could have been showing it to other people. If it's a desirable location and they have other people who can take that unit without extra work to them, then they might give it back to you.

Your cancelled check is your receipt. You paid the deposit to hold the apartment and now you don't want it so you think the landlord should just lose rent because you've changed your mind? You probably signed a lease, read it. You agreed to it. Usually there is a paragraph that states what will happen if you decide not to move in. I'll bet it says you lose your deposit. Don't you think that's fair? Why do you think a landlord has to absorb the cost and lose money? Everyone thinks that landlords are just awful, but you're the one breaking your word and you will pay for it. Geez, think about what's fair. . .if you hadn't held it for yourself, someone else would have rented it.

What do you think a deposit is for? Why would you renage on the deal. If the landlord held the apartment for you he lost money doing so and the deposit is to compensate him for that. You want to change your mind but the landlord to pay for you doing so?

I am landlord who is retaining a prospective tenant s $600 HOLD DEPOST for failing to move in. The house was ready and she was forwarded lease but never signed it or paid the remainder of the move in costs. She has since gone to police to try to get money back. The detective is clearly on her side calling the Oklahoma State Statutes I was citing nothing but "smoke and mirrors" and is threatening take the case to the DA for "obtaining money under false pretense" if I don t refund her money. I held the house from
October 8-November 1, cashed her hold deposit and put it in a separate escrow account as mandated and provided her a receipt and documented everything. I KNOW I did not break any laws and I FIRMLY BELIEVE I am justified in my resolve NOT to knuckle under to the bullying. Thoughts?

apartments dont usually want to give you back your deposit well they held your apartment for you and you decided not to move into it, if it were the other way around, they would be requierd to they will probably not give it back to you. They do not have to. But it certainly wont hurt to ask

sure, they are in a position to probable shop the deposit because of the fact they bumped off the premises from the marketplace to hold it for you. In doing so, they could perhaps have surpassed via numerous different means tenants. Sorry

did you sign a lease ?
if you did, you will have to pay the rent too, AND lose the deposit.

they held the apt , you paid for that. game over.
