In reality, some people enter litigation not only for the outcome, but to make the facts of the litigation a matter of public record. In such case, ADR would not be appropriate because it could result in keeping the matter secret (by having the file sealed by the Court).

Frankly, any dispute can be settled by the appropriate ADR procedure, but if the desired outcome requires a court order (injunction, for example), then it will have to go before a court at some point.
