Or acquit them all to protect the innocence of one who is truely innocent?

You don't know who the innocent one is...you just know one is innocent.

The crime is murder and the sentence is life in prison.

Nope I would find the innocent one not guilty. However todays prosecutors and law enforcement care for nothing except the advancement of thier carrers. They use creative imagination and think up ways to convict innocent people.

Actually -- if he has a good attorney -- each of them would be tried separately -- so that we wouldn't be faced with this decision. . . and, even if all five of them are tried in the same case at the same time, we can rule independently as to the guilt of each of them.

It doesn't matter whether or not I know which man was "innocent" (which, by the way, isn't legal, by any means) . . .

but, whether or not I know beyond a reasonable doubt that each man, independent of the others, is guilty as charged.

If I find one that isn't guilty beyond a reasonable doubt -- then, no -- I wouldn't find him guilty (but, I surely wouldn't exonerate the others -- since I can rule on them independently) . . . I would just find HIM not-guilty.

If they were all tried together and I knew one was innocent, I would acquit them all for justice on the innocent.

If you knew one was innocent, your duty would be to free the one and only prosecute the rest

If you knowingly prosecute an innocent person, you are in effect a kidnapper, and deserve jail yourself

regarding additional details, your unlikely hypothetical situation would place a 'reasonable doubt' on each of their heads.

I would demand seperate trials and prosecute them all. The cream will rise to the surface!

if you prosecute them all that dosnt mean they will all go to jail does it they will get seprete trials i think so i would say prosecute them all cant let four guilty guys go free expecially depending on what the crime was
