Americans are getting sick and tired of being Litigation Nation and you'd be hard pressed to find a judge or jury who will determine that you have been harmed in any way, emotionally or financially, by "offensive gestures". You probably won't even find an attorney willing to take it on; they don't like cases that don't show much promise unless their is a potential for a huge monetary reward. So unless the person you are suing is rich there is no pot of gold at the end of the tunnel that will make the attorney take the risk.

Call the cops and see if they can arrest this person for something.

You can sue for just about anything these days. As to the verdict, that is a question of where when and how this person id=s harrassing you and what effect, if any it has on you. When you sue someone, you are saying that the persons acts are causing you monetary harm. In some workpalce cases, there is room for harrassment complaints, but this does not usually result in a monetary settlement.
