On Friday night my cousin hit a girl in a night club.The girl used to be my cousins best friend, had been for 12 years, but she slept with my cousins husband behind her back,so my cousin saw red on friday night and attacked her in a club. My cousin has previously had a caution, years ago,but the ex best friend has decided to press charges.The girl has a very bruised face, scratches,hair pulled out. Does anyone have the slightest clue as to the outcome of this if it went to court and my cousin pleads guilty?

Oh yes. she already has been cautioned by the police after it happened.

I know its easy to judge, but she has three small children, and shes isnt the type of girl who fights,and she is fully aware 'it takes two to tango',she and her husband are now split up.

Depends on the Judge unfortunately. Our legal system is so cr*p that judgement varies from judge to judge.

She will get a slap on the wrist due to the exteme provocation involved. How big a slap depends on how badly injured the other party was. however she def wont go to jail as previous caution is likely to have run out and there fore will not be taken into account when sentencing. And another thing is if she pleads guilty at the first opportunity in the uk she will get athird of her sentence lopped of for saving the court time.
another tthing is if she has been cautioned for this offence then she will not have been charged. Police dont have to charge unless asked to and even then it is up to the procurator fiscal if there is enough evidence. She should plead guilty at the first opportunity....She will only get a fine!!!!

If she has no previous convictions they could use her as an 'example' and throw the book at her which for a charge of ABH would mean a custodial of 12 month. But with the prisons as full as they are they will probably give her some sort of probation, fine and court costs as well as a bind over where if she gets in trouble over a set amount of time the case would come back up again. Shes gonna have a record but thats about the worst.

This is a very sad situation. Usually, it ends up with the hitter paying restitution, maybe some fines. Jails are so overcrowded now, the judge is not likely to lock her up. She'll probably have to go to anger management or something. Eventually, it will be ok, if she keeps her nose clean otherwise and stays away from the tramp. And that jerk husband.

overcrowded prisons-plus judges differ but as there are injuries -in particular to a womans face-it`s a `toss in air of coin`!
it will probanly be `aggravated assault`-fueled not only by `domestics`-but alcohol as well.
so many factors-former caution for another!
probably-a suspended 3/6 months-and a fine.
possible damages-awarded at judges decision-possibly at another hearing-maybe not re: costs!

If your cousin was not taken to jail or actually arrested for this, it most likely wont be a big deal. It will probably be just a fine and community service.

Id say its a the point of.....the biggest lie wins, given the court system, prior caution, and they are now spilt..........
seems she was set-up, for some other action down the road...the kids, divorce. Yep! Id say them 2 plotted, planned, and set me up, in front of nightclub full of witnesses, espically because hes w/ her now. All the pieces are in place, to give it a go, and reverse the tables on them.........

She'll probably get community service or a fine when the circumstances of the attack come out.
Tell her to get a good lawyer.

either ABH or GBH charge will follow. If she bled then it will be GBH. You cousin is in trouble, he risks a custodial sentence. Very silly move. I am a criminal defence solicitor

I'd say it will depend to a large extent on any record she may/may not have.
I assume she's talked to a lawyer? Would seem like that would be money well spent.
